Suspended Sentence For Illegal Hazardous Waste Disposal

The Environment Agency announced on the 30th January 2013, that an Essex Landowner was in breach of two planning enforcement notices issued in 2002. The owner of the farm  Farm, was given an eight month suspended jail term, fined £35,000, and 180 hours of community service after being found guilty of running an illegal waste site. The farm located on green belt land in a Landscape Improvement Area, was found to be operating an illegal waste site between April 2008 and 2011 without the appropriate waste permit or planning permission. During this time, the owner was  served with two separate enforcement notices calling for him to remove all hazardous waste including tyres, vehicles, waste, caravans, a lorry and three mobile buildings. As of January 2013, only the mobile buildings have been removed. The courts have ordered the owner to clear the site by the 30th January 2014, and pay £20,000 of prosecution costs. 
The ownerwas found to be illegally burning waste, when Essex County Fire Services was called to 35 fires between December 2009 and June 2010. Environmental Agency surveillance revealed that lorry loads of waste was being delivered to the site and burnt. Fires fuelled by hazardous waste released black plumes of smoke into the atmosphere, and raised concern for surrounding businesses, highways and power supplies.
